Employment Law: Compliance Counseling

In response to the ever changing laws and regulations governing the workplace, the firm provides timely counseling, training and written alerts to ensure that our clients’ policies and procedures remain compliant. Our attorneys have extensive experience advising clients on numerous employment related issues, including: compliance with the Family and Medical Leave Act, the Fair Labor Standards Act, and the Americans with Disabilities Act; discrimination and retaliation; sexual harassment and workplace violence; employee benefit issues; reductions in force; occupational safety; and a variety of other personnel matters. As an employer’s response to employee complaints often directly or indirectly impacts its liability, we also regularly conduct internal investigations and identify appropriate remedial action.

We also prepare and update employee communications, including handbooks, letters, and policies, and render oral and written opinions on specific employment related issues. Our attorneys routinely analyze risks associated with proposed courses of action, and work to identify effective alternative courses when risk levels are unacceptable. Working in constant contact with our clients, our attorneys also assist and counsel in matters regarding hiring procedures, employee discipline and termination, work force organization and reduction, family medical leave, workers’ compensation and other employee disability matters.

For our public sector clients, we draft agency policies, procedures, and regulations and are often called upon to serve as procedural advisors. Our attorneys understand that public officials must answer to the communities they serve and often face unique and complex legal issues. We take a pragmatic approach to this area of law, working to ensure that our clients are able to meet all their business obligations while remaining true to their civic missions.

In the private sector, we understand that protecting human and intellectual capital is one of our clients’ highest priorities. The firm aggressively works to protect businesses from the threat of future competition presented by current employees. Our attorneys draft employment, confidentiality, non-compete and non-solicitation agreements designed to protect customer lists, trade secrets, and other confidential and proprietary information.
